I am pretty sure the suit you are thinking of was about the batteries dying
right after the warranty ran out and that Apple was recommending that you
just buy a new iPod and for a short time claimed that the batteries could
not be replaced (the case is very hard to open).

After a huge outcry, Apple changed their minds and you can get replacement
batteries.  There are also tons of instructions out there on how to change
the batteries yourself.
