It's a fishing expedition. They've been trying for years to get Rove to testify under oath since Bush was elected. They know if they make him testify long enough they can "Scooter" him. There's no actual wrongdoing. The AG's work at the pleasure of the president, and if they don't pleasure him they're out:) No crime to investigate unless you're swimming in the Kool-Aid bowl.
