Exactly, Slander is a malicious statement of facts.

Hustler printed something claiming Jerry Falwell lost his virginity to his
mother in an outhouse as I recall.

Falwell sued and lost. The Supreme Court said that the intent of the Hustler
piece, as vile and mean as it may have been, could not be seen by any
reasonable person to have been intended to be taken factually.
