And the owner of the business can make that choice. If they want a Spanish speaker dealing with English speakers, then that is fine.
It is only illegal to discriminate against people in jobs that are government funded, unless there is a state law saying otherwise. Affirmative Action, Civil Rights acts, and other similar legislation only affect public entities, not private ones. They are the ones who will have trouble communicating if they do not. As for hiring, remember that it is illegal to discriminate on the basis of race or national origin. If you are going to fire people for not speaking English, you would have to make sure that a) English is a reasonable job requirement and b) this does not impact members of one demographic group disproportionately. I am not a lawyer but it seems to me that this might be difficult. Where I thnk prejudices come in in *this* thread is when people start saying you need to speak English to drive or rent an apartment.
