And the owner of the business can make that choice. If they want a
Spanish speaker dealing with English speakers, then that is fine.

It is only illegal to discriminate against people in jobs that are
government funded, unless there is a state law saying otherwise.

Affirmative Action, Civil Rights acts, and other similar legislation
only affect public entities, not private ones.

As for legal documents, how can you hold somebody responsible that
signed a contract not knowing what it said?

I speak two fluently and two more badly but well enough to decipher
parts of a news article and understand answers to questions like what
time is the bus coming, how much is this food item, and where is the
restroom. I also took a couple of semesters of Japanese but no longer
claim any knowledge of it whatsoever. To answer the question.

And it doesn't matter to me what you expect, any more than it matters to
me what language the cashier at a Mexican restaurant speaks. Let people
learn what they want and what they can. They are the ones who will have
trouble communicating if they do not. 


As for hiring, remember that it is illegal to discriminate on the basis
of race or national origin. If you are going to fire people for not
speaking English, you would have to make sure that a) English is a
reasonable job requirement and b) this does not impact members of one
demographic group disproportionately. I am not a lawyer but it seems to
me that this might be difficult.

Where I thnk prejudices come in in *this* thread is when people start
saying you need to speak English to drive or rent an apartment. That's
just dumb.
