You're misreading me, or I'm not communicating effectively, or a little bit of both.
I'm saying basically what you're saying, except that they aren't interested in the behaviors at the granular *you* level; they are only interested in how the Great Throng will behave. In other words, the summary roll-up of all those granular you-level things into the 70-odd marketing types, one of which each of us fall into. As far as the power issue, we don't give them the powers they abuse. The abuse comes in when they exercise more power than they are allowed by law. They do this when they feel that they are insulated from the law by people who in essence control the law, or they don't think they will get caught.
