I doubt it would stand up in court. Whether or not it would or wouldn't I just 
don't see Adobe's point in this at all. So what if they are making money off of 
it. They are making money off of what was made with it not the actual flash 
product. That's saying if you make money off of building coldfusion sites that 
they can and will dictate to you what you can call or market those apps. Now if 
it was a product say called flashreplacement.com then I could see it but a site 
that promotes the use of the flash product??? Just stupid.

The funny thing here is that now they are not only going to sell flash but will 
now include silverlight and flex as well. Flex is no biggy but silverlight is a 
competitor to flash and this only hurts adobe. So abobe being anal just got 
"analed".
