Deputies serving a search warrant on Tucson's southwest side shot and killed a 26-year-old man after he fired a rifle at them, officials said. At about 9:30 a.m. Thursday the Pima Regional SWAT team arrived at the residence in the 7100 block of South Redwater Drive, near West Valencia and South Wade roads, said Deputy Jason Ogan, a Pima County Sheriff's Department spokes-man. Jose Guerena was inside with his wife and their 4-year-old son when he fired at deputies who had entered the home, Ogan said. It was unknown if the woman and child were in the same room as Guerena. The SWAT team announced themselves before they went into the house, although Ogan wouldn't elaborate on what caused officers to force their way into the home. Guerena fired his AR-15 rifle at the deputies, who were holding up shields, Ogan said. At least one of the shields was struck by gunfire, he said. It appears to be peaceful and quiet, but in transcripts officers stated they were on high alert, after being told the suspect they were about to encounter could be armed, and that they were heading to a home where the residents may be linked to home invasions, drug deals and possibly murder. When they get to the scene they quickly take up their positions. In an audio recording provided to KOLD News 13 by the Sheriff's Department, you can hear SWAT officers knocking on the front door and announcing who they are at least three times. They do this in both English and Spanish. After there is no answer, officers are show breaking down the front door. Within seconds of entry, you hear a barrage of gun fire. After all is quiet, the SWAT team sends a robot into the home, and discovers the body of Jose Guerena lying in the kitchen, next to a long rifle with a scope. Deputies describe seeing bullet wounds on his head, torso, arms, and legs. They also described seeing a lot of blood around him. In statements made to detectives after the shooting of Guerena, one deputy stated he opened fire after seeing a man pointing a rifle in his direction. He said he felt his own life and the lives of his teammates were in danger when he opened fire. He was unsure how many bullets he fired. Another officer stated he kept shooting "until his weapon ran dry" that is he ran out of bullets. He said he saw a muzzle-flash, and thought one of the officers had been hit, when he opened fire. But we are learning SWAT team members well trained in deadly force bring the potential to save lives too. SWAT team members say Jose Guereña was waiting with an assault rifle when they broke into his house to serve a drug warrant. He didn't fire, but they did and hit him multiple times. His wife remembers seeing him in a pool of blood, making noises that made her think he still had a chance. Of Note: Jose Guerena did not fire after all and medical attention was held back for close to 75 minutes. That can be drug ledgers, scales, anything that would be in furtherance of this narcotics conspiracy. And it involved all four residents that we were looking at in that quarter mile of so of each other." O'Connor: "We did find things that we were asking for in that. It may have been drug ledgers, narcotics paraphernalia, any other connecting material between the residences. Those things were found, in addition to a large sum of money. Somewhat larger that what you would expect to find in anyone's home." Waldman: "Can you say if that was the residence where the shooting happened?" O'Connor: "No, it was one of the four, but it was not that residence." Waldman: "In that specific residence, did you find anything related to drugs, drug money, in that specific residence." O'Connor: "We found information that was pertinent to this drug conspiracy case, yes. I'm not going to go into details on what those things were. But it was connecting material to the drug conspiracy." Of note: the did not find what they were looking for at this house though they did find "pertinent" information. Jose Guerena may have been guilty of drug trafficking, but it looks like Tuscon went way beyond what was necessary to serve a warrant. Finally, Pima County Sheriff Clarence Dupnik signed to order to send the SWAT team. If that name sounds familiar, it is. He blamed right wing talk radio hosts for the shooting of congress woman Giffords before the investigation.
