Was it an assassination when US soldiers killed dual national American citizens who were serving in the German Army during the first or the second world war, or in the first world war? What is the difference. There was even a brigade of Americans in the Waffen-SS. As far as I can see as soon as these two became traitors to the nation and actively planned and encouraged attacks on the US they became armed belligerents. This meant they were fair game in this case. As for the evidence there was plenty, from Hasan talking with al-Awlaki shortly before his shooting rampage, through the New York Times bomber and the christmas day bomber both attributing how al-Awlaki encouraged them and suggested targets etc. There is plenty of evidence that shows by words and deeds that these two were very much deserving of their treatment. He was in a part of Yemen that was not under the control of the central government, rather under the control of AQ, a hostile entity that had already struck the nation multiple times. He was with other armed belligerents - several pickup trucks filled with armed escorts.
