I am guessing they are hoping just the threat of a lawsuit will make the 
other guys decide it is easier/less costly to just buy the stuff, maybe 
as part of a settlement.

Our country has gone from a capitalist society where corporations serve 
a useful purpose, to one where corporations exist to maximize profits at 
any cost.  Leave it to humans to gravitate to the worst part of an 
otherwise good idea.
