actually, you get murder 3, which is "involuntary manslaughter".  still carries a 
stiff penalty.

A person gets drunk, drives home and kills a person - they aren't
charged with Murder, but a much lesser charge (prolly  ManSlaughter)

I'm of the opinion that if you drink, and then willingly get into your
car, you're weilding a lethal weapon, so if you knock somebody down, it
should be attempted murder AT LEAST

If you can imagine how strongly I feel about that, then extrapolate that
into gun control... Then again, growing up in a society without guns, I
can't imagine EVER wanting to own a gun <sigh>
