The Washington measure is set to pass, it's leading in the polls and
there is no organized opposition.  The Oregon measure will likely fail
but it is written substantially different than the Washington one.

They are going for the incremental approach in Washington. The measure
there would legalize sale and possession of less than an ounce of
marijuana but sales could only happen through government-regulated
outlets. Growing your own would not be legal. It also adds in tough
new rules about driving under the influence where it establishes a
base line level of compound found in your blood that would establish
the legal limit much the same way that blood alcohol content does for
alcohol-based DUI. There is some controversy about this part as the
science seems to be pretty new and it isn't clear to everyone that
there is a solid relationship between impairment and bloodstream
count. There also, I believe, is no field test available, it requires
a blood draw, so some folks worry that it is set up to allow for busts
with little or no evidence in the field.

The Oregon measure, on the other hand, is pretty loose. It sets up
potential regulation and taxation of sales through the State but also
allows for individuals to grow their own, which obviously bypasses the
whole state regulation part of things. It also does not limit
quantities of possession, nor does it address the issue of driving
while intoxicated.  For those reasons and others, the national backers
of the Washington measure have not thrown their weight behind the
Oregon measure and it doesn't seem to be doing as well here.

The hope amongst the backers of the Washington measure is that it is
well written enough, well regulated enough, that it represents an
incremental step and will not only pass at the ballot but also not
draw so much ire from the feds that it has a chance to work
effectively.

We shall see.
