The only large ISP's part is a bit weird, the additions to the list of agencies that can ask for this information is ridiculous, but I don't think there is anything fundamentally wrong with the idea that certain agencies can tap internet traffic if they have a court order. I suppose programs like PGP will simply become more popular :) On a side note: we have had this in the Netherlands for a few years now, but they still can't tap me completely.
