So they don't always win. But I think if they find out about it, they need to at least threaten to sue, or else they have not "protected" their trademarks or copyrights. Note, however, that I most certainly am not a lawyer. On the other hand, I once did a really good Jeopardy knockoff for an internal bank training seminar, and we did get it vetted through the bank's lawyers before we created it.
