yes, that was the word I was looking for - Plausible deniability.
I guess the current administration learnt from their experiment with Guntanamo that they can get away with anything and by being creative with their laws as well as relying on executive decisions. These were well applied in the use of contractors. In future we may see the use of non-American contractors so that they escape prosecution and liability in both Iraq and the US.

Of course, that's an unintended consequence of using contractors. Plausible
deniability its called. The phrasing was invented by a member of another
republican administration who had no qualms about breaking the law to
achieve its political goals.

Moreover contractors are not subject to the military code of justice, nor
may they be subject to US laws, as they are in Iraq. Given that there is no
real Iraqi justice system, these contractors can get away with anything.

The US military has determined that 2 of deaths in these prisons were caused
by one guard and one contractor. The guard is currently in custody waiting a
courts marshal. The contractor was merely fired.
