Since then another user has discovered the reason for this issue, which should negate your need for the workaround:  BofA mispells the Referer variable.

Go into the code and, for the CF 5 version of the cfhttp referer parameter, change the name of the parameter from 'referer' to "http_referer".  This is actually the name of the returned application server response and not the variable the browser is supposed to send to the server, according to the accepted W3C http standard, but waiting for BofA to realize this is a waste of time.

Note that the CF6+ version works properly with 'referer'.  Go figure.
