That would be great in a perfect world. But in THIS world fighting these kinds of
lawsuits can often cost more than a settlement and distract upper management from
running the business. Notice I said nothing about *losing* the lawsuit, just fighting
it.
These vultures who bring these lawsuits are not just "hoping" for something. This is a
well practiced science to them. They know exactly how much it will cost the defendant,
and they know all the tricks to drag it out. They will make it clear to the defendant
that they know exactly what it will cost and are willing to take less than that amount
to go away.
The precedent has been set long ago. Congress passed some tough legislation to clamp
down on exactly this kind of lawsuit very recently and the vultures have been making
only millions instead of hundreds of millions.
