I spoke too soon too, you are trying to cfset the query value inside the
recordcount check so that's not going to work either.
You probably want to do...
<cfif NOT len(trim(thisNL.alignHEAD))>
<cfset form.alignHEAD ="rgt" />
<cfelse>
<cfset form.alignHEAD =" " />
</cfif>
Then check form.alignHEAD to decide whether or not to check the box/radio
