Yes there are big issues with running apache 1.3. Basically you will be in a catch 22 situation unless you apply the cfmx updaters and upgrade to apache 2.043 +.
The updaters won't work without apache 2.043 + and you need the updaters to fix issues in the first release of CFMX. We upgraded to apache 2, applied the updaters have had no issues. Depends on how many custom modules you are running as to how hard the upgrade is.
