How long have you had him? I would say he is being given too much freedom. I would confine him to either a storage area or crate at nights. Also make sure you clean the spot with an enzymatic cleaner such as Natures Miracle. It gets rid of the smell so they won't go back to the same spot all the time. He may also be going outside and just running around and not pottying. I would take him out on a leash and reward him with praise or treats when he does go potty.
