I agree that this should be handled by window managers. The EWMH provides facilities for clients to request particular stacking orders; see http://standards.freedesktop.org/wm-spec/wm-spec-latest.html#STACKINGORDER, http://standards.freedesktop.org/wm-spec/wm-spec-latest.html#id2551694, and http://standards.freedesktop.org/wm-spec/wm-spec-latest.html#id2551529; clients can also open override-redirect windows and change their own stacking order. Unfortunately, this falls apart if/when there are multiple apps competing to make changes like these. It's safer to dictate policy in a single place. I'm pretty sure that I've seen "always on top" settings in multiple window managers, and http://burtonini.com/blog/computers/devilspie looks like it supports setting stacking order as well.
