There is much out there that I don't like or which bothers me that
people do, but isn't illegal. For instance, puppymills are not illegal
per se. (Maltreatment of animals is illegal). My comment had nothing
to do with taking sides.
I don't see that this woman is "passing off" her dogs as Cavalier King
Charles Spaniels. She makes it clear that they are not *our* Cavaliers;
to the point of creating a different breed standard. They are
derivative, however, of Cavaliers as she does say. So, I don't see
fraud here. She makes a point of distinguishing her "cavaliers" from
the Cavalier King Charle Spaniel.
It is not illegal to take money from people who want to join a private
club. I have no idea if her organization is for profit or is
non-profit; either way it is unclear how her charging dues is against
any particular law. The service that she provides could simply be
keeping records of her breedings and entering them into a stud book.
My point in mentioning the CKCSC, USA was that it provided such a
service for the then unrecognized Cavalier King Charles Spaniel when it
was formed.
So, my comment to you was really by way of asking what you thought was
illegal? If this woman DOES say that this new breed has some sort of
standing as a "recognized" breed or something of that sort, then perhaps
there would be some legal ground on which someone with standing could
pursue her.
I don't think that this world needs another breed of dog; we are still
trying to sort out the genetic problems of the existing dogs. I simply
don't think you can stop people from breeding crossbreeds to create
another breed, call it what they will, sell them and attempt to create a
new breed. This, as it is mentioned by several other breeders, has
happened in other breeds as well.
Of course you are not the "enemy", and I apologize if you took my
comment in that light. Often people see lawsuits as the only recourse
to things that they don't like, and I'm merely suggesting that, in cases
like this one, public education may be the better solution.
