That's not Clam's fault. On our product, if Clam dies, then mail is tempfailed. We **never** pass mail that has not been virus-scanned. If you have a filter that does, then complain loudly to whomever wrote it. (We do have a simple ClamAV watchdog script. It's rather specific to our product, but if people are interested, I can generalize it and donate it back.)
