If Sun makes you agree to their contract before giving you the spec, then that is a contract issue not a copyright issue. They are trying to keep the spec covered as a trade secret. For specs you can download without signing a license (which actually includes the Java api, since you can just use anonymous ftp if you know the path, which I do) then they would be making the more dubious claim that their API is copyright. -- Aaron M.
