Unfortunately that doesn't seem to be the only clause that is incompatible
with the (L)GPL but Paul Fisher advised to consult Richard Stallman for
the definitive answer. I will email him and ask for his advise.

The Jakarta people hope that they can work it out to a good conclusion
with Sun and they have been hostile in the past about making a implementation
of the javax.servlet classes or using another implementation of the
library. So we will just have to wait what Sun decides about the javax.servlet
classes. If Sun releases them as free software I would be happy to merge
them and otherwise we could offer them for inclusion. The Kaffe
people were also interested to include the libraries with Kaffe, but they
didn't seem to care exactly where the sources would be located as long as
they could be accesed by anonymous CVS. I personally do not mind so much
where the sources are since they are LGPLed and I would be happy to keep
maintaining them.
