1. Medicare MDS -- When dealing with Medicare MDS if the assessment window has not yet ended you may still set the ARD for any day in the window. Once the window has passed, you should set the ARD for the date on which you are working; you then have the usual amount of time to complete it. The facility will have to bill default for each day that the ARD is outside the assessment window (including grace days).
2. OBRA assessments -- You are not supposed to back date these. Set the ARD for the first available opportunity. Sign them off on the dates that things are completed. When I have had late OBRA assessments (e.g.resident got "lost" from the list or was in the hospital) I will put a note in the chart stating what happened. If it is a quarterly that is done late, I will "make up the time" by doing the next one sooner than the usual "90" days so that we get back on track for a timely annual. If it is the third quarterly that is late, do the annual sooner so that it is still on time. If you miss a quarterly all together, I would just go on from the new annual. If the annual is late, I would just keep the usual schedule working from the new annual date.
You will get error messages on your validation list. Just make sure that they say what you expect, e.g. that the R2 date and/or VB2 and/or VB4 dates are late. Assessments that are late will be accepted; if they are not, look for errors other than the dates. I have not had any actual repercussions from submitting late assessments, other than getting the error messages on the validation reports, and an occasional default payment for a Medicare assessment that was missed.
We do not use the MDS for Medicaid (New York State) so I do not know if there would be additional problems related to that.

I am going to a new facility and have already been told they are behind on MDS and they will not be doing MDS for about 2 weeks in that building until I start. I have never done a late MDS how does that work. Do you keep the same ARD and just have the R2 and V2 dates as the current date that you are doing them? How does anyone else do a late MDS?Lisa
