I think the issue here might be that the surveyors are less concerned with the timing aspect of the billing than the FI. The FI might want to enforce this, but I am not sure how they would. They do not have access to the MDS database to verify when the MDS was submitted. I bet that will be coming in the future.
 
Has anyone been through an FI chart audit recently? Did they ask for validation reports? I have never heard of an FI asking for them, but it makes some sense that they would if they suspected you were billing without submitting.
