California Administrative Code, Title 22, Division 5 Chapter 3, Section 72545- medical records must be in ink, capable of being photocopied and legible........................ I never recommend anything but yellow.

There is no requirement that the highlighter be "copyable" unless you are handing out copies to staff to use during the shift. In that case I could see why the surveyor expressed some concern. Even so, I don't think they will cite you for it.
