having just had my job eliminated when the hospital I was working for closed the
skilled unit, I feel for you. I would suggest that you take your problem to the EEOC
and ask them what can be done

>Hi, I need some advise from the people who are familiar with labor laws.
>(sorry it's so long)
>Our hospital is undergoing restructure and job cuts---and this is the
>scenario.
>We have 2 mds coor and 1 intake coor. hospital based skilled unit. Last week
>one of us was told our position would be cut by . and that we would not be
>able to bump out into the floor nurse population regardless of seniority,
>due to our job classification. When we had taken these positions we were
>told that they were lateral moves, with the same pay scale as the floor RN
>and that we were in the same job class----also in the past (as late as 2
>years ago) during restructure we were always placed in seniority with the
>floor staff. So today when I was trying to explain to our new nurse manager
>that we have always been considered equal, she investigated and then the VP
>of the hospital and the manager came to tell us that we were not in the
>floor nurse classification anylonger and also that our pay schedule was
>lower.. This information had never been shared with any of us, they then
>handed us our papers when we changed jobs and the one person's job transfer
>stated "lateral move" and it is the first time I had ever seen my sheet
>that was headed "employment status change" that was totally filled out by
>my old head nurse. None of us had been informed of this reclassification and
>we were all working with the knowledge that our jobs are fairly secure, and
>2 of use are in the top five in seniority. 28 years and 19 years. Now we
>find out that if they close our skilled unit we are unable to bump into a
>floor position and will be out the door, or apply for a posted position. So
>my question is do we have any rights since we were never informed of the
>changes. We do plan to file a letter with the head of Human Resources also
>stating that we were not informed of our job class change or pay change.
>Thanks for your input.
