It is my impression that upon the death of a resident that the facility may choose to release the record but isn't obligated to.  If the facility chooses not to release, the family would need to have a legal writ/subpoena to access the medical record.  This is in Ca.

Does anyone know the law regarding medical record release to family upon death of the resident. I have a family request to obtain the complete medical record of a resident who recently died. I have been told you must do this within 24 hours of the request. Is this correct?  Thanks. Jeanne
