That is what the new HIPAA regulations request. “By law the copies must be made within 2 working days. The recommendation is that you set up a meeting within 2 days of the request to review the records. Why does the family want the entire record?  “The requestor should have the legal authority to view the records, a meeting should be sent up within 24 hours required by law”.I would talk with the family and if they are amenable to come and review the record and let you know which copies they want it might save them and you both time and money.  Remember you are allowed to charge them for each page depending on your fee for copies are. If the time frame is a problem, they might agree to give you more time. Also I would let them know that you expect to be paid at the time of delivery.  Hope this helps.

Does anyone know the law regarding medical record release to family upon death of the resident. I have a family request to obtain the complete medical record of a resident who recently died. I have been told you must do this within 24 hours of the request. Is this correct?  Thanks. Jeanne
