Chris, The problem you have is a well-known problem of Cocoon or more precicly of Xalan. There are many mails in the archives about this topic (e.g.: http://marc.theaimsgroup.com/?l=xml-cocoon-dev&m=101994024218728&w=2).
If you want to use Saxon have a look at http://outerthought.net/wiki/Wiki.jsp?page=Saxon - it should help (and is faster than Xalan).
