One thing to note is that the handling of these files has been one of the
primary reasons why the release vote failed. I.e. there's surely something to
improve.
We may well be able to use these files directly under the exception, but if we
do, we need to ensure their licenses are properly in the LICENSE file, in the
NOTICE file if needed, and that there's a mention of them in the README. That's
my understanding at least.
