I believe this is a bug in Opera, yes. RFC 1867 states, in Section 3.3, "Each 
part should be labelled with an appropriate content-type if the media type is 
known [...] or as application/octet-stream". In the case of an empty input 
element of type 'file', the media type is clearly unknown, so the browser 
should be supplying 'application/octet-stream'. Since Opera is not doing this, 
it is in violation of RFC 1867.
