+1 to Rich's suggestion on preserving the existing behavior and changing the 
javadoc to clarify what that behavior is.

It seems important to preserve backwards compatability at this point, so the 
behavior of (localName, null) needs to be preserved.  The seperate Jira with an 
approach like (B) that continues to preserve backwards compatability while 
providing the ability to always create unqualified element seems like a good 
approach.
