On a different issue . . . . Can anyone tell me if any Con law casebooks address the history of the Constitution's development from the Declaration through the Articles and eventual ratifications of the Constitution? All of the casebooks that I have just begin with Marbury and judicial review.

Brest et al, Processes of Constitutional Decisionmaking begins with a short overview of the Constituiton's development from the Articles through ratification, and, of course, we distinctly do *not* begin with Marbury and judicial review.
