Sorry to keep bugging about this (And reply to my own post) I am completely stumped, 
what kind 
of hardware/kernel interaction might this be? is there anything I can do to narrow 
down the 
problem any further, all the posts related to this seem to only require recreating the 
device.

I would stick with 2.2 kernel, but then my sound card doesn't work... any and all 
suggestions
