Well..that is not completly true. It is not the BCI that is patented, but some specific algorithms which use information stored in the TTF that is interpreted by the BIC. You could also circumvent the patent by defining NO_APPLE_PATENT in some file (grep the source), although I think this is also not the case in RH rpm.
