I think somoebody posted on this list recently about this, you may use the  
models from mods of other commercial games, i doubt there s any chance the  
models from the commercial game itself may be availlable for free use,  
while there are some mods site where you can clearly see under which  
license the game was released.
There's this, and the typical issue: if you need to make something  
coerhent or original, you shall not sue the models from other games.
As for the format, you can bet on .obj files, usually they import quite  
well, between apps, but for the animations, that may be more difficult to  
get by, unless you use the character anmis from other games.
