Rob Gee Fitzgerald's term does not expire in October because GAO certified the funds to fund his appointment and investigation--on a permanent, indefinite basis; Ashcroft, through Comey, waived any need to oversee his investigation.  All this was legally approved with i's dotted and t's crossed at the time Fitzgerald was appointed.
