H.R. 1790 is scary all right, and it's not completely available on Thomas.  I
had my congressman send me a copy.  It's ten pages of how to eliminate the
American citizen's "right to know."  You would never know what it really is
from reading the title or the description of its content.  It gets really
interesting in some of the following passages:

 This concerns release of information in electronic form (in particular) or
in printed form as well under some circumstances.  Anyway, one of the more
interesting paragraphs says:

"Any officer or employee of the United States, or any officer or employee of
a State or local government, who knowingly violates a restrition or
prohibition established by this subsection, shall be fined under section 3571
of title 18, United States Code, imprisoned for not more than one year, or
both.'

It goes on with the next encouraging words:

"The Administrator may collect and maintain records that reflect the identity
of individuals and persons seeking access to information under this section
only to the extent that such collection and maintenance is relevant and
necessary to accomplish a legal purpose ...."

There is also the following:

"After consulting with other Federal agencies, the Administrator may make
off-site consequence analysis information available to the public in an
electronic form that DOES NOT INCLUDE INFORMATION CONCERNING THE IDENTITY OR
THE LOCATION OF THE STATIONARY SOURCES FOR WHICH THE INFORMATION WAS
SUBMITTED.  No other officer or employee of the United States, nor any
officer or employe of a State or local government, may make off-site
consequence analysis information available to the public in such form except
as authorized by the Administrator."

What I am reading here is that the public has no right to know, and if
anybody tells them he will be fined and put in the slammer.   I wish I knew
more about Virginia.  Isn't Olin or somebody headquartered there?  Mr. Bliley
appears to be a sneaky and evil man.  He has a lot of help.  This bill has
already had two hearings before the Commerce Committee.   It still has the
Government Reform and the Judiciary to go.  It is zooming along like a guided
missile.  The precedent it would set is horrifying.

I heard a part of the first hearing in the Commerce Committee.  C-SPAN ran it
at 5:00 a.m. on a Thursday morning.  The representative of the Fraternal
Order of Police who talked was very happy at the prospect of being able to
keep records on anyone who asked to see certain information.  They seemed to
be asking for positive input from one Atty Susman.  It was never clear whom
he represented.  Mr. Bliley[s bill got a plug from Mr. Bilbray.  He is also a
Republican but while Mr. Bliley is from Virginia, Mr. Bilbray is from
California.  He and the police want information about environmental hazards
restricted to those who "have a need to know and can be trusted to use it
properly."  And of course can be relied upon not to make chemical companies
uncomfortable.

If this bill passes, democracy (which requires an informed citizenry) is
dead.
