Three-Judge Panel to Name Former Deputy Counsel

ABCNEWS.com W A S H I N G T O N, Oct. 14 � Ken Starr plans to
resign this weekend and his replacement, a former deputy
independent counsel, will be named early next week, ABCNEWS has
learned.

     The three-judge panel that picked Starr is set to name Bob
Ray, a 40-year-old native Washingtonian who worked as a deputy
under Independent Counsel Donald Smaltz before joining Starr�s
office, where he will take over the sprawling nearly six-year
investigation of President Clinton.

     Although Clinton�s impeachment trial ended in his acquittal,
Starr�s office still has several open investigations and is
engaged in an ongoing discussion about whether to bring perjury
charges against the president once he leaves office. Worked on
Espy Investigation While working under Smaltz, Ray served as a
prosecuting attorney on the trial team that lost its case against
former Agriculture Secretary Mike Espy, who was acquitted on
dozens of corruption charges late last year. Ray served with
Smaltz from 1995 until this past April before heading to Starr�s
office for a six-month stint as a senior litigation counsel.

     Ray has kept a low profile during his career, but one former
prosecutor described him as a mild-mannered but tough prosecutor
who is extremely articulate.

     ABCNEWS learned in August that Starr had recommended three
of his deputies, along with six others � including Ray � to the
judges as possible replacements. Sources familiar with the probe
say Starr will submit his resignation this weekend.

     The law that created the office of independent counsel ran
out at the end of June, but its expiration did not affect already
operating probes.


Defends His Record Starr has continued to defend his
controversial investigation of Clinton�s affair with former White
House intern Monica Lewinsky, which led this year to the
president�s impeachment and acquittal earlier this year.

     Detractors have argued Starr�s Lewinsky investigation and
other matters involving the president smacked of partisanship.

     �Not once have we been found to have conducted ourselves
inappropriately,� Starr told a congressional committee reviewing
the independent council act in April.

     On the other hand, Starr said he thinks the 21-year statute
from which he drew his authority should not be renewed, calling
it �constitutionally dubious� and �hopelessly flawed.�

     Last month, Starr said he may not have been the right person
for the Lewinsky investigation in light of the amount of time he
had already spent investigating the president.

     �I think it would have been much better for the country for
the Lewinsky matter to have been handled by another independent
counsel,� he said.
