ACTION: Forfeiture Reform in Trouble in Senate!!!
Sessions teams up with Shumer to gut Forfeiture Reform Bill

On June 24 the U.S. House passed HR 1658, The Civil Asset Forfeiture
Reform Act of 1999, which was cosponsored by Rep Ron Paul and had
the active support of the Libertarian Party.  The LP national office issued
an action alert on June 19 and a press release on June 23 urging support
of the measure, which "would weaken the government's power to seize
your property."

The bill has been referred to the Senate, but so far no one has introduced
the bill as passed in the House.  However, the current issue of the Drug
Reform Coordination Network's weekly online newsletter (at www.drcnet.org)
has the
following alert from the Drug Policy Foundation:

DPF Alert: Senator Session's Version of Civil
Asset Forfeiture Reform Bill Worse than Nothing;
Public Action Needed

Sen. Jeff Sessions (R-AL), a former federal prosecutor, introduced
the "Civil Asset Forfeiture Reform Act" (S. 1701) on October 6. The
bill, presented as a companion bill to Rep. Henry Hyde's (R-IL) "Civil
Asset Forfeiture Reform Act" (H.R. 1658), is actually a substitute. It
guts nearly all the reforms from the House bill and makes it easier for
law enforcement to seize and keep private property. The Drug Policy
Foundation recommends that you contact your Senators to urge
them to oppose S. 1701 and to encourage them to introduce Rep.
Hyde's bill in the Senate.

Sessions introduced his bill with Sen. Charles Schumer (D-NY) as the lead
co-sponsor. Other cosponsors include Sen. Strom Thurmond (R-SC), Sen.
Joseph Biden (D-DE), Sen. Jesse Helms (R-NC), Sen. Dianne Feinstein (D-CA),
and Sen. Max Cleland (D-GA). The Department of Justice, the FBI, the DEA
and numerous law enforcement organizations support Sessions' bill.

As the alert indicates, Sessions bill doesn't just weaken HR 1658 but
rather contains sections designed to STRENGTHEN the government's
power to seize your property.  HR 1658 contains only 5 sections,
whereas S. 1701 contains 32.  Here is a sample of the provisions
added in Session's bill:

SEC. 18. ACCESS TO RECORDS IN BANK SECRECY JURISDICTIONS.

SEC. 19. COOPERATION AMONG FEDERAL PROSECUTORS.

SEC. 20. ACCESS TO OTHER RECORDS.


We need to urge support for the original bill HR 1658
and oppose Session's substitute S. 1701:

Dear Senator,

Henry Hyde's Asset Forfeiture Reform bill, H.R. 1658, passed
overwhelmingly in the House of Representatives and is an important
measure that deserves the support of the Senate.

Jeff Sessions' S. 1701 would send our unjust Asset Forfeiture Laws
much further out of control.  Please Sponsor Legislation similar
to Hy'des H.R. 1658.  Please oppose S.1701 or any similar legislation.

It is time to honor our Constitution and restore Due Process of Law
to our legal justice system.
