FOR IMMEDIATE RELEASE - FLORIDA AUGUST 19, 2000 URGE FOR AN IMMEDIATE STAY OF THE EXECUTION OF A SUICIDAL BIPOLAR INMATE The impending execution of David Hauser by the State of Florida is disturbing for several reasons, two of which are mentioned here. As a minimal response, the issues mentioned herein should be further investigated. It has long been recognized in both Canon and Secular Law that a person who is "INSANE" is not responsible for his acts. Although the definition of "INSANITY" in law has been fluid through the ages, an INSANE person -- however the word is defined -- is protected by the law. In the past, several certifiably insane people have been executed by the civil authority, the prototype being Albert Fish (New York 1936), or Lowell Andrews (Kansas 1962) both of whom were INSANE beyond doubt. The legal definition of INSANITY has no counterpart medically, and this is the source of much controversy . David Hauser has been diagnosed as a bipolar personality and has been bent on self destruction from an early age. Bipolar is a recognized mental disease, that in phases can express itself in acute psychotic depressive or manic manifistations. Indeed the bipolar disorder can be a component of other mental diseases. David Hauser is by all accounts "sick". Part of that sickness is a desire for self destruction, and the ideation leading to it, which Mr. Hauser has had for a long time - clearly long time documented. This is no game to avoid execution. The current Florida law does not take into account the warped reasoning that compels Mr Hauser to seek his own death. He confessed to a crime he committed solely to get sentenced to death, and gave out particularly heinous details to insure his death sentence. The state of Florida has the opportunity to revise its law about insanity and responsibility, and by so doing lead the way into a new understanding of how to deal with crime and insanity. Even with a "mercy killing" the assisting person is held accountable as a first degree murderer in Florida (State v Gilbert). Is the state exempt from its own laws? While assisted suicide is not legal in the United States (State v Kevorkian) that is exactly what the State of Florida is doing. Those few people who want to kill themselves but lack the courage to do so, now have a mechanism to have the state kill them. Hauser's desire to kill himself is a chronic desire, brought about by mental disease - if that is not insanity, pray tell what is? It is therefore an act of Justice and Morality for the state of Florida to postpone his killing until this question be further explored. This cold blooded killing of an helpless individual should be postponed for those reasons.
