LAWYER SAYS HE NIXED BID TO INFLUENCE VOTING CHIEF

The Democratic lawyer for Palm Beach County's elections
supervisor said yesterday former Secretary of State Warren
Christopher tried to get him to push for a manual recount - hours
before the state high court ruled on the matter.
Christopher, who is leading Vice President Al Gore's campaign's
recount effort in Florida, made the call Thursday to Bruce Rogow,
lawyer for elections supervisor Theresa LePore.
"It was an effort to have me persuade my client to vote in favor
of starting the manual recount on Thursday," Rogow said. "I told
him no. I told him we'd have to wait."
The Florida Supreme Court wound up clearing the way for workers
to begin hand-counting the county's 462,350 ballots a few hours
after Christopher's call.
Rogow said he was talking with Alan Dershowitz, the Harvard law
professor representing some Palm Beach County voters, when
Christopher buzzed him.
But Rogow said he didn't think it was appropriate for either
Christopher or Dershowitz to try to "persuade me to give certain
advice to my client."
Neither the Gore or Bush campaign was immediately available for
comment.
Meanwhile, in Broward County's recount yesterday, the canvassing
board said it couldn't decide what to do with hundreds of
uncounted "dimpled" ballots.
The votes, the board noted, are most probably for Al Gore.
Canvassing board chairman Robert Lee said it would be up to the
courts to make one of the most critical rulings since the recount
of Broward's 587,928 votes began Wednesday.
"We will do whatever the law requires us to do," said Lee. "In
all likelihood, the majority of those [uncounted votes] will go
to Al Gore. I want that to be clear."
Gore beat Gov. George W. Bush here by a 2-to-1 margin. With 207
of 609 election precincts retallied as of late yesterday, the
veep had picked up only 59 extra votes.
That made the hundreds of uncounted ballots, segregated since the
start because they had only indentations instead of full
punctures, a potential electoral gold mine for Gore.
Lee acted after Democrats went to court Thursday, arguing that
the "intent" of voters was ignored when indented ballots were
shunted aside. Canvassers in Palm Beach, where a recount is also
underway, are counting deep indents as votes.
Circuit Judge John Miller seemed to hand the Democrats a victory
when he said the canvassers were not supposed to "limit their
examination to one or two criteria." But the judge also said he
wasn't issuing a specific order and needed time to "assemble my
thoughts."
