Just when you thought you had heard the last of his treachery and his secret attempts to circumvent the Constitution and the rule of law. Just when you thought you had heard the last of the way he insults the United States and its most revered institutions when he is on foreign soil. Now comes shocking news from the United Nations! New information from Geneva, Switzerland reveals that Bill Clinton filed a stealth report with the United Nations to circumvent the U.S. Supreme Court. As a result, that Clinton Report could cause an unprecedented constitutional crisis when some claim that U.N. Treaty obligations trump U.S. Constitution provisions. In 1995, the U.S. Supreme Court ruled, in Adarand Constructors, Inc. v. Pe�a, that Congress may not willy-nilly use racial quotas and preferences: "We are one race here; it is American!" Experts say the ruling means an end to racial quotas and the dawn of the dream of a color-blind Constitution. Clinton was furious with that ruling. So furious, he vowed he would "not end" racial quotas and preferences. In fact, he sent one of his top officials to tell the Senate that he would not obey the Supreme Court until it issued a second ruling! Can you imagine the arrogance of that testimony? Millions of Americans, including judges, knew Clinton and his lawyers were stonewalling the Supreme Court. Three judges at a federal appellate court fumed: "[T]he integrity of the judicial process has been compromised [because Clinton's] United States Attorney [has been forced to choose] between allegiance to politics and service to the court.. The uncomfortable sense that the rule of law was sacrificed to politics is all but escapable." But stonewalling the federal judiciary was not the only way Clinton was fighting to save racial quotas and preferences. While his first way was bold and brazen, his second way was sly and sneaky. And it was classic Clinton; after all, Clinton quibbled over the definitions of "is," "alone," and "false." In 1994, the U.S. Senate ratified a treaty called the International Convention on the Elimination of All Forms of Racial Discrimination (ICERD). The Treaty did just what it said; it barred each and every form of racial discrimination. No quotas, no preferences, no type of racial discrimination! Clinton saw an opening. While the American people were watching the close presidential election of 2000, the Clinton Report was submitted to the United Nations. As interpreted by the Clinton Report, the racial quotas and preferences that had been barred by the Treaty not only would be permitted, they would be required! The Clinton Report turned the Treaty on its head! That's not all. In the Clinton Report, Clinton impugned the Supreme Court, openly attacking its recent decisions. It was bad enough that Clinton stonewalled the Court. Now, before foreign nations, he openly assailed it! It gets worse. Because the Constitution places treaties on a par with the Constitution, the Treaty, as interpreted by the Clinton Report, could place the Treaty in direct conflict with the rulings of the Supreme Court. Imagine that, the United Nations would be telling the United States that on matters of racial quotas and preferences, the ultimate authority is not the Constitution, as interpreted by the U.S. Supreme Court, but a Treaty, as interpreted by Clinton and as enforced by the U.N. This could cause a constitutional crisis unlike any in our history, especially since it involves the volatile issue of race! If you don't think the United Nations would foment such a crisis, consider two things. First, the unceremonious way the U.S. was dumped from the U.N. Human Rights Commission after European "allies" assured the U.S. that they would vote to keep the U.S. on the panel. Second, the ungracious way President George W. Bush was received on his June visit to Europe; one writer described it as "a European orgy of anti-Americanism [and] Yankee-bashing . not seen since the days of Ronald Reagan." Can it get any worse? Yes! Remarkably, the very Clinton official who gave the Clinton Report to the U.N. is still our representative on the Treaty. That's not all. She has assembled a powerful team of non-governmental organizations (NGOs) that favor racial quotas and preferences to help her lobby for approval of the Clinton Report. Worst yet, she will argue for the report's adoption, on behalf of the Bush Administration, in a few short weeks. Mountain States Legal Foundation (MSLF) is fighting back.
