My understanding is that the Firearms acts in current force do not as such ban things but proscribe them. Handguns were moved out of one section and into another which our FACs and the authority of Chief Constables does not cover. The failure of the NPA legal action I believe fell on this point. So it is no good appealing against a decision of a Chief Constable that he/she cannot give. OK so far. Jack Straw it seems is giving consideration to allowing the 'importation' of handguns for competitive use on a restricted basis and for restricted use at a restricted venue. These handguns will be possessed by their owners in a wholly legal manner. These owners will be British as well as Foreign. This would set a legal precedent and unusually the same precedent for Foreigners. This would set the basis for a legal equality claim (both British and EU) for the same consideration for any similar, future circumstances. If any of that 'holds water' then it would be open to anyone to apply to the Home Office on these grounds and have that application considered in the same way expecting the same issue of any exemption. This is not something that could have been done before as it was not the custom to target shoot with section 5 firearms that would have needed a consideration along the lines of the current Commonwealth Games exemption. If this makes any sense then we should all stand by to apply to the Home Office for exemptions under the above precedent. If nothing else they would have to process thousands of applications which would be a shame, wouldn't it?
