How  Martin could be found guilty of murder but not guilty of attempted 
murder.

A letter from Lord Donaldson in the Times (27/4/2000) explains:

"... However, as the law stands, proof of an intention to kill is not an 
essential ingredient of the crime of murder. Proof of an intention to cause 
grevious bodily harm suffices. Anomalously, proof of an intention to kill is 
an essential element of the lesser crime of attempted murder. Perhaps this 
aspect of the law would also repay further consideration."
