Legal aspects aside .
Why does it have to be OSM. 

Any specific reasons. 

IMO the best source to do that is 

http://www.naturalearthdata.com/

Why 

Al its data is already in Shapefile format. 

It is in public domain........ Most important. So you are allowed to edit 
it and use it commercially also.

It has very many different layers. 

By combining the following  two layers You can create the desired map. 

1. ne_10m_admin_0_countries_lakes
2. ne_10m_admin_0_disputed_areas

You just add the Disputed areas claimed by India to the boundary of India 
in first layer.

Whether it will become correct as per LAW I can not say. 

Probably no one can say. The laws relating to maps in India are weird to 
say the least.

I have created and shared some maps using Natural earth here in this forum 
you may search.
