Presumably the fix is to require that users set Dir::State to somewhere cron-apt can write, then it will not touch the usual apt config. Is it safe for users to use /var/lib/cron-apt for this location? my reading is that this will put lists things under /var/lib/cron-apt/lists. (But now of course to actually install updates, the user must remember to run 'aptitude update' to update the "real" lists in /var/lib/apt...
