I think the most proper thing to say is "It's confusing."  Some parts of
TeX say some things and others say other things.  There may be some
conflicting claims.

Regardless, the TeX license and the LaTeX license are two different
things, and may share any number of similarities or differences.  But
the question at hand regards the LaTeX license, and its relationship to
the DFSG, which is (somewhat) orthogonal to its relationship to TeX.
